Welcome to the ISO Photo XP LLC ("ISO Photo XP," "we," "us," or "our") website. By accessing or using our website and services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our website or services.
1. Services
ISO Photo XP provides youth sports and competition photography — including Media Day (team & individual), game-day action, gymnastics meets, marching band, tournaments, and team products such as banners, composites, and digital and print packages. We primarily serve the Nashville, Tennessee area and travel nationally for events. Specific service terms, deliverables, timelines, and pricing are established through individual client agreements and are separate from these website terms.
2. Eligibility
Use of this website and our services is limited to individuals who are at least 18 years of age. By using this website or engaging our services, you represent and warrant that you are at least 18 years old and have the legal authority to enter into binding agreements.
3. Copyright and Intellectual Property
All content on this website, including but not limited to photographs, text, logos, graphics, videos, and design elements, is the property of ISO Photo XP LLC and is protected by copyright and intellectual property laws.
- You may not reproduce, distribute, modify, or use any content without prior written permission from ISO Photo XP.
- All photographs taken by ISO Photo XP remain the intellectual property of ISO Photo XP LLC unless otherwise specified in a separate written agreement.
- Client usage rights for photographs are defined in individual service agreements and do not transfer copyright ownership.
- Images displayed in an online gallery are governed by Sections 4 and 5 below, which set out what may and may not be done with a gallery image.
4. Gallery Images, Screenshots, and Permitted Use
Images displayed in an ISO Photo XP online gallery are provided for the sole purpose of viewing and purchase. No license, ownership interest, or right of use is granted by access to a gallery. A license to use an image arises only upon purchase of that image or upon written consent from ISO Photo XP.
Without purchase or prior written consent, you may not:
- Screenshot, screen record, download, save, scrape, or otherwise capture any gallery image or gallery preview.
- Repost, publish, distribute, transmit, display, or share any gallery image on social media, websites, messaging platforms, print, or any other medium.
- Crop, blur, clone over, obscure, edit, filter, or use any software, application, or artificial intelligence tool to remove or diminish an ISO Photo XP watermark.
- Reproduce any image on apparel, headwear, banners, signage, merchandise, or any other physical or digital product.
- Use any image for advertising, promotional, fundraising, sponsorship, or other commercial purposes.
- Provide any image to a third party, including another photographer, print laboratory, designer, publisher, or media outlet.
Commercial use requires a license. Purchased images are licensed for personal, non-commercial use only. A separate written commercial license from ISO Photo XP LLC is required for paid advertising of any kind, sponsor materials and sponsor presentations, business social media accounts, websites promoting a business or organization, product packaging, merchandise offered for sale, recruiting services, publication by media outlets, and any other use that promotes an organization or generates revenue. Purchase of an image does not grant a commercial license.
Third-party transfers require a written use release. Where a purchaser wishes to provide a purchased image to a third party — including an outside designer, print laboratory, sign shop, publication, sponsor, or school — the purchaser must first obtain a written use release from ISO Photo XP LLC identifying the recipient, the permitted use, and the term. Use releases are issued at no charge on request. Providing an image to a third party without a use release constitutes unauthorized use under these Terms, regardless of whether the image was purchased.
Any image bearing a visible ISO Photo XP watermark, and any image from which a watermark has been removed or obscured, is an unpurchased image. Use of such an image in any form constitutes unauthorized use under these Terms.
Purchased digital files are licensed for personal, non-commercial use by the purchaser and their immediate family unless a broader license is granted in writing. Altering a purchased image — including heavy filtering, artificial intelligence restyling, compositing, or re-cropping — and publishing it as ISO Photo XP work requires our prior written consent. Complimentary image sets furnished to a contracted organization are licensed for that organization's own promotional use and may not be resold or relicensed. 5. Unauthorized Use, Invoicing, and Notification
ISO Photo XP treats unauthorized use of its images as theft of copyrighted work. Where unauthorized use is identified, the following applies:
- Notice and opportunity to cure. As a courtesy, we will ordinarily contact the responsible party first and provide an opportunity to remove the image or complete the purchase before any further step is taken. This courtesy is offered at our discretion and is not a waiver of any right.
- Direct invoicing. The responsible party — whether an individual, parent, guardian, athlete, or the contracted organization — will be invoiced directly for each image and each instance of unauthorized use, at our then-current commercial licensing rate. Where the responsible party is a minor, the invoice is issued to the parent or guardian.
- Organizational notification. The contracted organization, booster club, coaching staff, school, athletic department, and any applicable governing body associated with the image or account will be notified of the unauthorized use and of the party determined to be responsible.
- Collection and legal remedies. Unpaid invoices may be referred to collections. ISO Photo XP LLC reserves all rights and remedies available under the United States Copyright Act and other applicable law, including the issuance of DMCA takedown notices to platforms hosting the image and recovery of costs and attorney's fees where permitted.
- Gallery access. We reserve the right to suspend or revoke gallery access for any account associated with unauthorized use.
Contracted organizations are responsible for relaying these image use requirements to the athletes, parents, guardians, and families connected to their program, and are asked to do so before the scheduled shoot and again upon gallery release.
If you need an image for a specific purpose and purchase is not workable, contact us before using it. We work with families and programs on access and pricing, and a request costs nothing.
6. Image Use and Model Releases
All images captured by ISO Photo XP are subject to model release agreements where applicable and comply with universal photo copyright standards. By engaging our services at games, meets, competitions, or other public-facing events, attendees acknowledge that photographs may be taken and used for portfolio, marketing, social media, and promotional purposes. Specific image usage terms are outlined in individual client agreements.
7. Booking and Payment
All bookings are subject to availability and require a signed service agreement. Payment terms, including deposits, are outlined in individual client agreements.
- A non-refundable retainer may be required to secure your event date.
- Cancellation and rescheduling policies are defined in your service agreement.
- Payment is processed through secure third-party payment providers. ISO Photo XP does not store credit card information on our servers.
8. Use of Website
You agree to use this website only for lawful purposes. You may not:
- Use the website in any way that violates applicable laws or regulations.
- Attempt to gain unauthorized access to any part of the website or its systems.
- Use automated systems, bots, or scrapers to collect data from the website without express written permission.
- Interfere with the proper functioning of the website.
- Download, copy, or redistribute photographs or other content displayed on this website.
9. Contact Form Submissions
When you submit information through our contact or scheduling forms, you consent to us using that information to respond to your inquiry and provide relevant service information. We handle all submitted information in accordance with our Privacy Policy.
10. Limitation of Liability
ISO Photo XP provides this website and its content on an "as is" and "as available" basis. We make no warranties, expressed or implied, regarding the accuracy, completeness, reliability, or availability of the website content.
To the fullest extent permitted by law, ISO Photo XP LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of this website, our services, or any related transactions. Our total liability for any claim related to our services shall not exceed the amount paid by you for the specific service giving rise to the claim.
11. Indemnification
You agree to indemnify and hold harmless ISO Photo XP LLC, its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of this website, violation of these terms, or infringement of any third-party rights.
12. Third-Party Links and Services
Our website may contain links to third-party websites or services that are not operated or controlled by ISO Photo XP. We are not responsible for the content, privacy practices, or terms of any third-party sites. Your interaction with third-party services is governed by their respective terms and policies.
13. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the State of Tennessee. Any disputes arising from these terms or your use of our website or services shall be resolved in the courts located in Montgomery County, Tennessee.
14. Changes to Terms
We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to this page. The effective date will always be noted at the top. Your continued use of the website after any changes constitutes acceptance of the updated terms.
